Terms of service

1. Overview

These Terms of Service ("Terms") govern your use of comparadar.com and any purchase you make through it (together, the "Service"). The Service is operated by NodiumTech LLC, a Texas limited liability company doing business as Comparadar ("Comparadar," "we," "us," or "our"). By visiting the Service or placing an order, you agree to these Terms and to the policies they reference, including our Privacy Policy, Shipping Policy, and Refund Policy. If you do not agree, please do not use the Service.

Our store is hosted on Shopify Inc. ("Shopify"), which provides the e-commerce platform we use to offer products to you.

2. Eligibility and US-only sales

You must be at least 18 years old, or the age of majority in your state of residence, to place an order. We sell and ship products only to addresses in the United States. We may refuse or cancel orders that do not meet these requirements.

3. Our role and the brands that ship your order

Comparadar is the seller of record for products purchased through the Service. Products are made by third-party brands and shipped directly by those brands through Shopify Collective. When you place an order, the brand receives the order and shipping information necessary to fulfill it, process returns, and provide warranty service. Comparadar remains your point of contact for questions about your order.

4. Product information and comparisons

Our comparisons are based on specifications published by manufacturers. We have not physically tested products unless a page clearly states otherwise. Manufacturer claims, including EMF levels, irradiance, and FDA status, are attributed to the manufacturer and have not been independently verified by us. We work to keep information accurate and current, but specifications, images, prices, and availability may contain errors or change without notice. We may correct errors at any time, including after an order has been placed.

5. Health and safety

Content on the Service is general information and is not medical advice. Talk to your doctor before starting sauna or light therapy, especially if you are pregnant, have a heart condition, or take photosensitizing medication. Read and follow the manufacturer's instructions, warnings, and electrical and installation requirements. You are responsible for using products safely and as directed by the manufacturer.

6. Prices, payment, and taxes

All prices are in US dollars. Prices and availability may change without notice. Payments are processed through Shopify Payments. By providing a payment method, you confirm that you are authorized to use it. Applicable sales taxes are calculated and collected at checkout where required. Shipping charges are calculated at checkout.

7. Orders

Your order is an offer to buy. An order confirmation email confirms that we received your order; it does not mean the order has been accepted. We may limit quantities, or refuse or cancel any order, including for suspected fraud, pricing or product information errors, or unavailability. If we cancel an order after you have been charged, we will refund the amount charged. Cancellation requests are reviewed manually, as described in our Refund Policy.

8. Shipping, title, and risk of loss

Shipping is governed by our Shipping Policy. Title to and risk of loss for products pass to you when the products are delivered to the shipping address you provide.

9. Returns and refunds

Returns and refunds are governed by our Refund Policy, which includes a 30-day return window.

10. Warranties

Comparadar is an authorized retailer of every brand sold on this site: each brand lists its products with us through Shopify Collective and ships your order directly. Products are covered by the manufacturer's written warranty, if any, as published by the manufacturer and shown on the product page. Warranty service is provided by the manufacturer; email support@comparadar.com with your order number and we will connect you with the brand's warranty process and confirm your purchase to the brand.

Comparadar does not provide any separate written warranty.

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, ANY IMPLIED WARRANTIES ON A PRODUCT, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE, ARE LIMITED IN DURATION TO THE TERM OF THE MANUFACTURER'S WRITTEN WARRANTY FOR THAT PRODUCT. IF THE MANUFACTURER PUBLISHES NO WRITTEN WARRANTY FOR A PRODUCT, THAT PRODUCT IS SOLD WITHOUT ANY IMPLIED WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE, TO THE EXTENT PERMITTED BY LAW. Some states do not allow limitations on how long an implied warranty lasts or the exclusion of implied warranties, so the above limitation or exclusion may not apply to you, and you may have other rights that vary from state to state. Nothing in these Terms limits any rights you have under the Magnuson-Moss Warranty Act or your state's consumer protection laws.

The full text of each manufacturer's written warranty is available before you buy: each product page links to the manufacturer's published warranty terms, and we will send you a copy free of charge if you email support@comparadar.com with the product name.

If a brand's warranty terms would not cover a purchase made through Comparadar, we do not list that product until the brand confirms coverage in writing.

11. Accounts

If you create an account, you are responsible for keeping your login information confidential and for activity under your account. Please provide accurate, current information and keep it up to date.

12. Reviews, comments, and feedback

If you submit reviews, comments, questions, or other content, you agree that it will be truthful, reflect your own experience, disclose any material connection you have to a brand or to Comparadar, and not be unlawful, defamatory, or infringing. You grant us a non-exclusive, royalty-free license to use, display, and reproduce your submission in connection with the Service. We may remove content that is spam, unlawful, abusive, unrelated to the product, or otherwise in violation of these Terms, but we will not remove or hide reviews because they are negative.

13. Third-party links and services

The Service may link to third-party websites, including manufacturer websites, and may in the future include affiliate links, which we will label. We are not responsible for third-party content, products, or practices, and your use of third-party sites is governed by their terms.

14. Intellectual property

The Service and its original content, including text, comparisons, graphics, and design, are owned by NodiumTech LLC or its licensors. Brand names, product names, and trademarks belong to their respective owners. You may not copy, reproduce, or distribute our content without permission, except for personal, non-commercial use.

15. Prohibited uses

You may not use the Service to violate any law; infringe the rights of others; submit false or misleading information, including fake reviews; transmit malware or interfere with the security or operation of the Service; collect data through automated means without our permission; or place orders for resale without our written consent.

16. Disclaimer

EXCEPT AS EXPRESSLY STATED IN THESE TERMS, THE SERVICE AND ALL CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE." WE DO NOT GUARANTEE THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.

17. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, NODIUMTECH LLC AND ITS MEMBERS, MANAGERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICE OR ANY PRODUCT. OUR TOTAL LIABILITY FOR ANY CLAIM RELATED TO A PRODUCT WILL NOT EXCEED THE AMOUNT YOU PAID FOR THAT PRODUCT. Nothing in these Terms limits liability that cannot be limited under applicable law.

18. Indemnification

You agree to indemnify and hold harmless NodiumTech LLC and its members, managers, employees, and agents from claims, losses, and expenses, including reasonable attorneys' fees, arising from your breach of these Terms or your violation of any law or third-party right.

19. Governing law and venue

These Terms are governed by the laws of the State of Texas, without regard to its conflict-of-law rules. Any dispute arising from these Terms or the Service will be brought exclusively in the state or federal courts located in Harris County, Texas, and you consent to their jurisdiction. Nothing in this section removes protections you have under the consumer protection laws of your state of residence that cannot be waived by agreement. Before filing a claim, please contact us at support@comparadar.com so we can try to resolve the issue informally.

20. Changes and termination

We may update these Terms by posting a revised version on this page and updating the "Last updated" date. Changes apply to orders placed after they are posted. We may suspend or terminate your access to the Service if you violate these Terms.

21. General

If any provision of these Terms is found unenforceable, the remaining provisions remain in effect. Our failure to enforce a provision is not a waiver. These Terms, together with the policies referenced above, are the entire agreement between you and us regarding the Service.
